This Terms Of Service serves all forums and services hosted at RPGworlds.

The services provided here are subject to the following T.O.S (Terms of Service), which may be updated by us without notice. It is suggested that you check them periodically for updates and changes.

The term RPGworlds shall apply to all sites making use of RPGworlds services, regardless of what those services may be, throughout this Terms Of Service.

Description Of Services
RPGworlds currently provides users with access to forums, message boards, member profiles, chats, and more. In order to use the services here, you must be connected to the web, either directly or through devices allowing access to web based content. Plus, you must provide all equipment necessary for your connection to the web, including a computer and modem, or other device. Please be aware certain areas of RPGworlds may contain adult or mature content. You must be at least 18 years of age to access such areas.

Registering
You must agree to provide true, accurate, current and complete information about yourself on the registration forms of any service you register with, keep all information up to date and accurate, and be at least 13 years of age. Those found committing fraud may have their account suspended, or possibly terminated, as well as refused future service.

RPGworlds Privacy Policy
RPGworlds will never give out your personal information, or email, without proper judicial process.

Member Conduct
RPGworlds does not guarantee the accuracy, integrity or quality of member placed content. You understand you may be exposed to things you might find offensive, indecent or objectionable. RPGworlds is not responsible, nor liable, for content made by individual members. The member who places the content accepts all responsibility, and liability, for their content on registering.

Things you will not do here:
  • You will not upload, post or otherwise transmit, things that are unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
  • You will not harm minors in any way! If you do, there will be an investigation, and when found, you WILL be prosecuted to the fullest extent of the law!
  • You will not impersonate any person or entity, including, but not limited to, RPGworlds staff, forum owners, forum administrators, or staff. Neither will you misrepresent your affiliations with any of the afore mentioned individuals.
  • You will not attempt to make unauthorized changes to the services provided.
  • You will not upload, post or otherwise transmit, things you do not have a right to transmit under any current laws, or contractual agreements.
  • You will not upload, post or otherwise transmit things that infringe any patent, trademark, trade secret, copyright or other proprietary rights of any party.
  • You will not upload, post or otherwise transmit unsolicited or unauthorized solicitations, advertisements, scams, schemes, etc. Spam and Junk Mail are strictly prohibited within, and by, RPGworlds.
  • You will not upload, post or otherwise transmit anything containing software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, or telecommunications equipment.
  • You will not disrupt the normal flow of dialogue, cause a screen to "scroll", or engage in harassment activities against any person, or forum, within RPGworlds.
  • You will not interfere with or disrupt the service, servers, or networks connected to the service, or disobey any requirements, procedures, policies or regulations of RPGworlds, or those sites it hosts.
  • You will not intentionally or unintentionally violate any applicable local, state, national or international law.
  • You will not "stalk" or otherwise harass another. Violations will be investigated, and when necessary and possible, prosecuted to the fullest extend of applicable laws.
  • You will not collect or store personal data about other users without their express consent.
  • You will not promote or provide instruction about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals.
  • You will not attempt to migrate forums wars, flame wars, etc. into RPGworlds from other sites, nor attempt to start them within RPGworlds, or the sites it hosts.
  • You will not use your account as storage for remote loading or as a door or signpost to a site beyond RPGworlds.org.
  • You will not register for multiple accounts any RPGworlds service without first seeking permission to do so from RPGworlds, and the staff in charge of that particular service, giving them all relevant information on all accounts.
  • You will not cross post inflammatory messages between forums, nor indulge in activities that will cause distress among, or animosity between, forums or services hosted by RPGworlds.
Submitted Content
RPGworlds makes no claims of ownership to the content placed by members. However, in placing content, you grant RPGworlds a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the content for the promotion of your site, and its presence within RPGworlds. If your account is ever terminated, the content will be removed, and all promotions will cease.

You understand RPGworlds does not pre-screen content, but RPGworlds does have the right to remove any content violating this T.O.S. You bear all risks associated with your content, including its accuracy, completeness, or usefulness.

Indemnity
You agree to indemnify and hold RPGworlds, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and volunteers, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your content, your use of the service, your connection to the service, your violation of the T.O.S, or your violation of another's rights.

No Resale Of Services
These services are offered freely for your use. You agree not to sell, abuse, or exploit any portion of these free services.

Modification Of Services
You understand RPGworlds may at any time modify or discontinue, temporarily or permanently, the services provided here without notice. You agree RPGworlds shall not be liable to you or to any third party for any modification, suspension, or discontinuance of these free services.

Termination
You agree RPGworlds may, at its discretion, terminate your account, and all services associated with your account without prior notice, if it is believed you have violated these Terms Of service. You agree RPGworlds may at any time discontinue current and/or future services without notice, and without any liability to you or any third party.

Advertisements
The only advertisements, if any, placed by RPGworlds anywhere within any forums may be a small, unobtrusive banner graphic in the upper right hand section of the top frame to help with the expense of providing RPGworlds services. Any, and all, other advertisements will be placed in an on site mall, accessible via a link placed in either the navigation bar, or top frame. No! large, popup, flashing, wiggling, or adult adds or banners, will be permitted.

Links
RPGworlds provides links to other web sites, but accepts no responsibility, or liability, of any kind for their content. If you choose to use the links, you visit the associated sites completely at your own risk.

Proprietary Rights
You acknowledge and agree the services and software used in connection with these services may contain proprietary and confidential information protected by applicable intellectual property and other laws, and may be protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

Disclaimer Of Warranties
You completely, and without question, understand the following:
  • Your use of these services is completely, absolutely, and irrevocably at your own risk. They are provided on a AS IS and AS AVAILABLE basis. RPGworlds offers no warranties or guarantees whatsoever with the use of these services to you, or any third parties.
  • Any material you choose to download, or obtain through the services here, is done completely, absolutely, and irrevocably at your own risk. RPGworlds accepts no responsibility, or liability, for any of it. You are solely responsible for any damage to your computer system, or loss of any data that may result from any downloading of material.
  • No advice or information, whether oral or written, obtained by you from RPGworlds shall create any warranty, or guarantee, not expressly stated within this T.O.S.
Limitation Of Liability
You understand and agree RPGworlds shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. Including, but not limited to, loss of goodwill, use, data, or other intangible losses, (Even if RPGworlds has been advised of such damages), resulting from the use or inability to use these services.

RPGworlds shall not be held liable for the cost of procurement of substituted goods, and services resulting from any goods, data, information, or services purchased, obtained, or messages received, transactions entered into, through, or from the service.

RPGworlds shall not be liable for any unauthorized access to, or alteration, of your transmissions, data, statements or conduct of any third party, or any other matter relating to the service.

Admonition For RPGworlds Services Relating To Financial Matters
These services are provided for informational purposes only, and no content included in the service is intended for trading or investing purposes. RPGworlds shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted via the service, and shall not be responsible or liable for any trading or investment decisions made based on such information. Remember: "Let the buyer beware!"

RPGworlds Notices
Occasionally RPGworlds may send out notices to inform its members of service changes, T.O.S. changes, updates, important events, etc. However, as this may not always be the case, it would be more prudent to check RPGworlds main page for any announcements pertaining to the services provided by RPGworlds.

Copyrights
RPGworlds will do its best to protect the intellectual property of others. RPGworlds respects the intellectual property rights of others and we ask our users to do the same.

General
The Terms Of Service constitutes the entire agreement between you, RPGworlds, and any sites it provides services for, and governs your use of the services. It supercedes any prior agreements between you and RPGworlds, its staff, partners, or affiliates. You may also be bound by additional terms and conditions when you use affiliate, partner, or other third party services or software.

The Terms Of Service and the relationship between you and RPGworlds shall be governed by the laws of the State of Pennsylvania without regard to its conflict of law provisions.

You and RPGworlds agree to submit to the personal and exclusive jurisdiction of the courts located within Mifflin County, Pennsylvania.

The failure of RPGworlds to exercise or enforce any right or provision of the Terms Of Service shall not be deemed as a waiver of those rights or provisions.

If any provision of the Terms Of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms Of Service shall remain in full force and effect.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of RPGworlds services, or the Terms Of Service, must be filed within one year after such claim or cause of action arose or be forever barred. The section titles in the Terms Of Service are for convenience only and have no legal or contractual effect.
